Welcome to The Viking Webdesign. By engaging our services, subscribing to our plugins, or purchasing our development services, you agree to the following terms and conditions. Please read them carefully.
1. Services Overview
1.1 Custom Development Services
We provide custom WordPress development, plugin development, web design services, and custom solutions as specified in project proposals and contracts.
1.2 Plugin Subscription Services
We provide premium plugin subscriptions for web design and development purposes with ongoing updates and support.
1.3 Service Delivery
All deliverables will be provided according to agreed specifications and timelines outlined in project proposals or subscription terms.
2. Custom Development Services
2.1 Project Terms
2.1.1 Client is responsible for providing necessary content, assets, and feedback within agreed timeframes.
2.1.2 All project specifications must be finalized and approved in writing before development begins.
2.1.3 Standard payment schedule is 50% upfront and 50% upon project completion, unless otherwise agreed in writing.
2.2 Satisfaction Guarantee & Remedies
2.2.1 100% Satisfaction Guarantee: We stand behind our work and guarantee client satisfaction with all deliverables.
2.2.2 No Refund Policy: Due to the nature of custom development work, no monetary refunds will be provided once work has commenced.
2.2.3 Resolution Guarantee: In case of client dissatisfaction with deliverables that do not meet the original agreed specifications:
- We will provide free revisions and fixes to bring deliverables in line with original project specifications
- Additional development time will be provided at no extra cost to meet agreed requirements
- This guarantee applies only to deviations from the original written specifications and approved project scope
- Changes to requirements, design preferences, or additional features beyond original scope are considered new work and will be charged separately
2.2.4 Important Limitation: The satisfaction guarantee does not cover:
- Changes in client preferences or design taste after project approval
- Additional features not specified in original project scope
- Modifications requested due to client change of mind
- Requirements that were not clearly communicated during project planning phase
2.3 Support Period
Free bug fixes and minor adjustments are provided for:
- Basic projects: 30 days
- Advanced projects: 60 days
- Complex projects: 90 days
3. Plugin Subscription Services
3.1 Subscription License
3.1.1 When you subscribe to a plugin, you receive a non-exclusive, non-transferable license to use the plugin in accordance with these terms.
3.1.2 The license duration is valid for 1 month or 1 year, depending on the subscription plan selected.
3.1.3 Subscriptions are billed on a recurring basis (monthly, yearly, or as specified) and will automatically renew unless canceled before the next billing cycle.
3.2 Plugin Updates and Support
3.2.1 We provide updates to improve plugin performance, compatibility, or security. Access to updates is included for active subscriptions only.
3.2.2 Subscribers are eligible for customer support as specified in the subscription plan. Support is provided during regular business hours.
3.3 Plugin Subscription Payments
3.3.1 By subscribing to our plugins, you agree to pay all fees associated with your subscription through approved payment gateways.
3.3.2 Subscriptions automatically renew unless you cancel prior to the renewal date. You authorize us to charge your payment method for recurring subscription fees.
3.3.3 All plugin subscription payments are final and non-refundable. Once a subscription payment has been processed, you will not be eligible for a refund, in part or full, under any circumstances.
3.3.4 You may cancel your subscription at any time. Your access to the plugin(s) will continue until the end of the current billing cycle.
4. Payment Terms (All Services)
4.1 Custom development projects follow payment schedules outlined in individual project contracts.
4.2 Subscription model payments (Options 2 & 3) follow specific terms outlined in individual contracts.
4.3 Additional work beyond original scope will be charged at €125/hour.
4.4 Rush delivery requests incur a 50% surcharge on total project cost.
4.5 Third-party service costs (APIs, hosting, licenses) are passed through to client at cost.
5. Intellectual Property & Ownership
5.1 Custom Development Projects:
- Option 1 (Custom Build): Client receives full ownership and commercial rights to all deliverables
- Option 2 (Viking Subscription): Client receives custom version with lifetime updates; The Viking retains rights to create marketplace version
- Option 3 (Partnership Model): Shared ownership structure with revenue sharing as specified in individual contracts
5.2 Plugin Subscriptions: The intellectual content of the plugin, including its containing code, is the property of The Viking Webdesign. Copying, reproducing, or distributing the plugin or its code in any form without prior written approval is strictly prohibited.
5.3 All custom development source code and documentation are provided to client upon final payment.
6. User Responsibilities
6.1 Proper Use
You agree to use our services and plugins only for lawful purposes. Unauthorized resale, redistribution, or modification of plugins is strictly prohibited.
6.2 Account Security
You are responsible for maintaining the confidentiality of your account information, including passwords, and for all activities under your account.
6.3 Project Cooperation
For custom development projects, clients must provide timely feedback and content as agreed to maintain project timelines.
7. Scope Changes & Additional Work
7.1 Changes to original project scope require written approval and may incur additional costs.
7.2 The satisfaction guarantee (Section 2.2.3) applies only to deliverables that deviate from original agreed specifications.
7.3 Client changes of mind, new requirements, or modifications beyond original scope are considered additional work charged at €125/hour.
7.4 Major scope changes may require project timeline adjustment.
8. Warranties & Limitations
8.1 Bug-Free Guarantee: All custom development deliverables are guaranteed to be free from bugs and function as specified.
8.2 Performance Standards: All websites will be optimized for performance and follow WordPress coding standards.
8.3 Compatibility: All work will be compatible with latest WordPress version and specified plugins.
8.4 Limitation of Liability: To the fullest extent permitted by law, The Viking Webdesign is not liable for any damages resulting from the use, misuse, or inability to use our services or plugins, including loss of data, profits, or business operations. Our liability is limited to the total project cost or subscription fee paid.
9. Communication & Timeline
9.1 Project timelines are estimates based on client providing feedback and content within agreed timeframes.
9.2 Delays caused by client feedback or content provision may extend project timeline accordingly.
9.3 Communication during business hours (Monday-Friday 9:00-18:00 CET) will receive response within 4 hours.
10. Termination
10.1 Custom Development Projects: Either party may terminate the project with 7 days written notice. Upon termination, client pays for work completed to date.
10.2 Plugin Subscriptions: We reserve the right to suspend or terminate your subscription if you violate these Terms and Conditions. Upon termination, access to subscribed plugins will be revoked immediately, and no refunds will be issued.
10.3 All completed work and source code will be provided to client upon final payment.
11. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Clients and subscribers will be notified of changes via email or on our website. Continued use of our services following such updates constitutes acceptance of the revised terms.
12. General Terms
12.1 These terms are governed by Dutch law.
12.2 Any disputes will be resolved through mediation first, then Dutch courts if necessary.
12.3 Individual project contracts may include additional specific terms.
